The automobile industry is a crucial pillar of the national economy, playing a significant role in national economic and social development. To address the impact of the international financial crisis and implement the overall requirements of maintaining growth, expanding domestic demand, and adjusting the economic structure, the state has formulated an automobile industry adjustment and revitalization plan, as well as a series of policies and measures such as "automobiles to the countryside" and "trade-in" to stabilize automobile consumption and accelerate structural adjustment. These measures have played an important and positive role in promoting the sustained, healthy, and stable development of the automobile industry and the steady and relatively rapid development of the economy. Relevant departments of administration for industry and commerce, transportation, and quality and technical supervision at all levels should fully understand the importance of strengthening the supervision of automobile sales practices and automobile parts quality in ensuring the specific implementation of national policies and measures for the adjustment and revitalization of the automobile industry, guaranteeing road transportation, and protecting the legitimate rights and interests of consumers. They should thoroughly implement the Scientific Outlook on Development, earnestly implement the spirit of the 17th National Congress of the Communist Party of China, the Third and Fourth Plenary Sessions of the 17th Central Committee, and the Central Economic Work Conference, further enhance their sense of responsibility, mission, and the overall situation and service awareness, give full play to their functional roles, effectively perform their statutory duties, actively maintain order in the automobile market, and promote the healthy development of the automobile industry.
Local industrial and commercial administrative departments should increase the frequency of routine inspections, strengthen supervision and inspection of automobile sales practices, and severely crack down on unfair competition and false advertising that infringe upon consumers' legitimate rights and interests, effectively regulating automobile market transactions. They should thoroughly investigate leads on suspected unfair competition discovered during routine inspections and appeals/complaints, and legally investigate and punish automobile brand dealerships and centralized automobile markets for unfair competition practices such as false representation and misleading advertising that defraud consumers. In conjunction with the special campaign against commercial bribery, they should severely crack down on automobile brand dealerships that leverage services like auto loans and insurance to solicit "rebates" or "commissions" from financial service companies, guarantors, and insurance companies. They should strengthen monitoring and inspection of automobile-related advertising and promptly investigate and punish any illegal advertising. They should further standardize automobile sales contracts, actively promote model contracts, and legally address "霸王条款" (overbearing clauses). They should strengthen administrative guidance, comprehensively using administrative warnings and suggestions to prevent operators from bundling goods or imposing unreasonable conditions against the wishes of purchasers.
Local departments of administration for industry and commerce, transportation, and quality and technical supervision should, together with relevant industry organizations, strengthen publicity and education for automobile manufacturers and sellers, automobile parts manufacturers and operators, and repair operators. They should urge automobile manufacturers to strengthen product quality management, strictly implement the "Regulations on the Recall of Defective Automobile Products," and publish maintenance technical data for new models. They should guide automobile brand dealerships to publicize their automobile parts supply systems, guide operators to clearly indicate information such as automobile parts manufacturers, parts prices, and service prices, improve quality management systems and relevant regulations on product "three guarantees," advertising, sales contracts, installment loans, insurance, and other sales services, promote industry self-discipline, and regulate the business practices of the automobile sales and automobile repair industries.
